Upon purchase, we guarantee on‑time setup and resource assignment within 24 hours. ⛔ NO REFUND AFTER RESOURCES ASSIGNED
If you wish to cancel and obtain a refund, you must request it before our team begins work. Once developers, designers, or infrastructure are allocated to your project (usually within 24h of purchase), the service is considered rendered and non‑refundable. This policy is clearly disclosed prior to purchase and complies with 16 CFR §435 (FTC Mail/Internet Order Rule).
This Refund and Legal Policy is adopted by Digitial LLC Florida and governs all services provided under the brand Digital Art. It is drafted in accordance with the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435), the Uniform Commercial Code (§2-508, §2-607), and Florida Statutes Chapter 501 (Consumer Protection). Every customer agrees to these terms at the time of purchase.
Cancellation window
You may cancel any service within 24 hours of purchase and before resource assignment. If work has not commenced, a full refund is issued within 5–7 business days. After resource assignment, no refund is possible – this is clearly stated and accepted at checkout.
Limited exceptions
Refunds are only possible in these specific cases:
- Duplicate or erroneous charge
- Service not delivered within 15 days of promise (material breach)
- Persistent technical failure that we cannot remedy after 3 attempts
Processing & law
Approved refunds are credited to original payment method within 5–7 business days. All refunds are governed by Florida law; no restocking fees are charged. Disputes are subject to Miami‑Dade County jurisdiction.

Governing law & consumer rights
Federal Trade Commission (FTC)
This policy fully complies with 16 CFR Part 435 – the Mail, Internet, or Telephone Order Merchandise Rule. We explicitly state the 24‑hour resource assignment and the cutoff for cancellation. No hidden terms.
Uniform Commercial Code
UCC §2-508 (cure of improper tender) and §2-607 (acceptance of goods) govern our obligation to remedy defects. Refunds are offered only when cure is impossible.
Florida Statutes – Title XXXIII
§501.211 (unfair or deceptive acts) and §501.976 (telephone solicitation) – not applicable; we operate as a registered Florida LLC. All disputes are resolved in the Circuit Court of Miami‑Dade County, Florida.
15 U.S.C. §45 – FTC Act
Prohibits unfair or deceptive acts. Our refund disclosure is conspicuous, repeated, and acknowledged before payment.
Customer acknowledgment & binding effect
By completing a purchase with Digital Art / Digitial LLC Florida, you expressly acknowledge that you have read, understood, and agreed to this Refund and Legal Policy. You confirm that:
- You understand that resource assignment occurs within 24 hours and makes the service non‑refundable.
- You consent to the exclusive jurisdiction of Miami‑Dade County, Florida for any dispute.
- You agree that this policy supersedes any contrary terms unless agreed in writing by an officer of Digitial LLC.
This policy is effective as of March 1, 2018. Digitial LLC Florida reserves the right to modify these terms, but any modification will not affect purchases made prior to the change. If any provision is found unenforceable under Florida or federal law, the remainder shall remain in full force. No refunds after resource assignment – you agree to this binding term.
