BINDING TERMS – READ BEFORE PURCHASE

You expressly agree that:

• Resource assignment within 24h: After payment, we assign developers/infrastructure. NO REFUND after resource assignment – you accept this irrevocable condition.
• PCI DSS compliance: All payment data is handled by our PCI‑DSS Level 1 certified processor. We never store full card numbers [citation:3].
• Liability cap – 12 months fees: Consistent with market standards and payment processor requirements, our total liability is limited to the fees paid for the specific service in the preceding 12 months [citation:2][citation:4].
• Governing law & disputes: This SLA is governed by Florida law. Any dispute shall be resolved exclusively in Miami‑Dade County, FL. You consent to this jurisdiction [citation:5].

These terms are conspicuously disclosed prior to any payment. By signing below, you acknowledge and accept them.

Liability & dispute resolution – binding

Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, DIGITIAL LLC FLORIDA‘S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS PRECEDING THE CLAIM. THIS CAP COMPLIES WITH PAYMENT PROCESSOR REQUIREMENTS AND REFLECTS MARKET STANDARD [citation:2][citation:5].

Governing law & venue: This SLA is governed by the laws of the State of Florida, United States, without regard to conflict of laws. ANY DISPUTE SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS SITTING IN MIAMI‑DADE COUNTY, FLORIDA. YOU IRREVOCABLY CONSENT TO THIS JURISDICTION AND VENUE [citation:5].

PCI DSS compliance acknowledgement: Client acknowledges that our payment processor is certified PCI DSS Level 1. Full card data is never stored by Digital Art. This SLA is consistent with applicable payment network rules [citation:3].

Electronic signatures & unique IDs

Typing your name constitutes a binding electronic signature under the U.S. ESIGN Act and Florida law. Dates are autofilled.

By signing, you confirm that you have read, understood, and agree to all terms above, including: 24h resource assignment (non‑refundable), 12‑month liability cap, PCI DSS compliance, and exclusive Florida jurisdiction. This agreement is enforceable under Florida Statute §501 and UCC 2‑607. A unique electronic identity is embedded in the generated PDF.
