These Terms of Service ("Terms") govern all services provided by Digitial LLC Florida d/b/a Digital Art (22661 SW 157TH AVENUE, MIAMI, FL 33170). By accessing or purchasing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services. These Terms comply with applicable federal and Florida law.
Medical & EMR
Web design for medical professionals, EMR interfaces, medical billing dashboards. HIPAA‑inspired layouts, patient portals, secure data visualization.
Ecommerce & WP
Custom e‑commerce websites, WordPress plugin development (static/dynamic builders), full shopping cart integration.
App & Web app
iOS, Android, and cross‑platform applications; web app design; Google Workspace integration (AppScript, Calendar, API).
AppScript workshops
Google API automation – small ($890), medium ($1200), large infra ($2500). Includes custom scripts, sheets/docs automation, workflow engineering.
All services are delivered digitally. Detailed project scope is provided prior to engagement. Any add‑on services must be agreed in writing.
All prices are in United States Dollars (USD). Payments are processed through secure third‑party payment gateways. You agree to pay the full amount specified at checkout.

Resource assignment & non‑refundable nature: Within 24 hours of purchase, we assign designers, developers, or infrastructure. After this point, no refunds are available except as expressly stated in our Refund Policy.
Our refund and legal policy is fully integrated into these Terms.
You may cancel within 24 hours only if no resources have been assigned. After that, the service is non‑refundable. Limited exceptions (duplicate charge, material breach, uncured technical failure) are detailed in the Refund Policy (effective Mar 1, 2018). That policy is binding and incorporated by reference.
You agree not to initiate any chargeback, reverse, or dispute any credit card or payment processor transaction for validly purchased services. If you believe a refund is warranted, you must first contact us directly at start@digitalhub.art and allow us 7 business days to resolve the issue.
If a chargeback is filed in violation of this clause, you shall be liable for all associated fees, penalties, and legal costs (including reasonable attorney fees) incurred by Digitial LLC Florida. This dispute resolution procedure is required prior to any chargeback and is material to these Terms. Governing law: Florida Statutes §501.211 and UCC §2-607.
Cap on liability
To the maximum extent permitted by law, Digitial LLC Florida’s total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
No consequential damages
We are not responsible for lost profits, data loss, business interruption, or downtime, even if advised of the possibility. Some states do not allow limitation of implied warranties or consequential damages; this limitation shall apply to the fullest extent permitted by Florida law.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the Circuit Court of Miami‑Dade County, Florida, or the United States District Court for the Southern District of Florida. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue.

Clear disclosure & compliance
You expressly acknowledge that we have clearly disclosed, prior to purchase: (i) the total cost, (ii) the 24‑hour resource assignment and non‑refundable nature, (iii) our refund policy and chargeback prohibition, and (iv) these Terms in full. This satisfies all requirements of applicable payment card network rules and federal regulations.
Modifications
We may revise these Terms from time to time. The most current version will always be posted on this page. Continued use of our services after changes constitutes acceptance.
Severability
If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
These Terms of Service are effective March 1, 2018 and supersede all prior versions.
